so my D3 account was banned. If I get a new account and link it to the same paypal will I get insta-banned?

No, an accounts previous infractions have no effect on a new license.

I am 100% sure, but there is no reason not to create a new account as xjohnsonx suggested to ensure a sense of ease about the situation. I know because I used to have very close proximity to a Blizzard support employee.

Blizz wants to SELL, so nobody will ban you just because you did nasty things on a previous account. They will wait until you screw-up again briggrin

(and if you're a scammer there is a chance that it will happen pretty soon)
