Doubt they would do that.
They'll probably just send updates that aren't compatible with your system after you've modified it in some way, kindof like the infinite looping brick that happens to modified Wii's.
You'll hear about the bricking the first day DS3 comes out. People will try to use r4's on them and you will hear what happens and what does not happen.
It's completely in their right to do it if they did, as it's their software, even though you own the hardware you have eula's on your ass. Although it's a bad idea, say if someone were to try and exchange their ds3 into a shop for a console / game of another type or flat out cash.
All in all I'll probably get a DSi XL sometime soon and a DS3 later (less $$) when the new console will be coming out because I'm a cheap bastard.
/Edit: and by doing that, I remain happy until no more consoles are being made.
The only games worth playing on the DS series are Pokemon games anyway.

That's basically what I said. That's what they said about Pokemon Diamond/Pearl.
You wouldn't be able to go online if you used a Game Shark. But that didn't happen obviously.
